These Terms of Use (“Terms”) are a binding agreement between you and California Medical Equipment (“we”, “us”, “our”). They apply to your use of www.calmedequipment.com (the “Site”) and to every product, service and feature we offer through it. If you do not agree with these Terms, please do not use the Site.
By browsing the Site, creating an account or placing an order, you confirm that you have read and accepted these Terms and our Privacy Policy. You must be at least 18 years old, or the age of legal majority where you live, and able to enter into a binding contract. If you use the Site for an organization, you confirm that you have authority to bind it.
We may update these Terms from time to time. The “Last updated” date at the top shows the current version. Changes apply from the date we post them, and continued use of the Site after that date means you accept the updated Terms. For major changes we may also notify you by email or a notice on the Site.
You may use the Site for lawful purposes only: to browse our products, request quotes, place orders and contact us. You agree not to:
Some features may require an account. You must give accurate and current information and keep it updated. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorized use. We may suspend or close an account that we reasonably believe breaks these Terms or is used fraudulently.
We try to describe and display our products as accurately as possible, but colors, images and specifications on the Site may differ slightly from the actual item. Placing an order is an offer to buy. We accept it only when we confirm shipment, and we may decline or limit any order, for example because of stock, suspected fraud or a legal restriction.
Prices are shown in US dollars (USD) and may change without notice. Unless stated otherwise, prices do not include shipping, taxes or duties, which are shown at checkout.
If a product is listed at a wrong price or with wrong information, we may correct the error and cancel or refuse affected orders, even after we confirmed the order or charged your payment method. If you were already charged, we will refund the full amount to your original payment method.
By placing an order you confirm that you are allowed to use the payment method provided and that the details are correct. Payments are processed by secure third-party providers; we do not store full card numbers. Shipping times, charges, returns, refunds and warranties are described in our Shipping Policy and Return and Refund Policy, which form part of these Terms. Refurbished products are sold as described on their product pages and may carry a different warranty from new products.
The Site sells medical and emergency equipment, such as AEDs, EKG devices, accessories and training products. Please note:
All content on the Site, including text, images, graphics, logos, product descriptions, layout and code, belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may view, print or download parts of the Site for your personal, non-commercial use, or to place an order with us. Any other use, such as copying, republishing, selling, distributing or modifying content, needs our prior written permission. You must not remove copyright or other ownership notices.
California Medical Equipment, our logos and our other brand names are our trademarks. Other brand names on the Site belong to their respective owners and are used only to identify their products. Nothing on the Site gives you the right to use any trademark without the owner’s written permission.
If you submit reviews, comments, messages or other content, you confirm that you own it or have the right to share it, and that it does not break these Terms or any law. You give us a non-exclusive, free, worldwide licence to use, display and reproduce it in connection with the Site. We do not review all user content and are not responsible for it, but we may remove any content that we believe is abusive, unlawful, misleading, infringing or otherwise unacceptable.
The Site may link to websites run by others. We do not control them and are not responsible for their content, privacy practices or availability. You visit them at your own risk and should read their terms. If you find a broken or harmful link, please tell us.
The Site and its content are provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, secure or error-free, or that its information is always complete, accurate or current. Product warranties, where they apply, are those given in our warranty terms and by the manufacturer. Some places do not allow these exclusions, so they may not apply to you.
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of, or inability to use, the Site or our products, even if we were told such damage was possible. Our total liability for any claim relating to the Site or an order will not exceed the amount you paid us for the order in question. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
You agree to defend and hold harmless California Medical Equipment, its owners, directors, employees, agents, licensors and suppliers from claims, losses, damages and costs, including reasonable legal fees, that arise from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
You may stop using the Site at any time. We may suspend or end your access, or cancel pending orders, if you break these Terms, misuse the Site or if we are required to by law. Sections that by their nature should continue after termination, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, will remain in effect.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. The courts of Los Angeles County, California, USA have exclusive jurisdiction over any dispute relating to the Site or your purchases, unless the law gives you the right to bring a claim elsewhere. Before starting any formal proceeding, we encourage you to contact us so we can try to resolve the issue informally. Any claim must be brought within one (1) year after it arises, to the extent the law allows.
