New York requires AED programs to follow rules for maintenance, training, medical oversight, device placement reporting, and post-event reporting. Good Samaritan immunity in New York only applies to AED use, leaving other program-related activities unprotected. The law’s vague wording creates uncertainty about the scope of conduct covered. AEDs are required in various locations, such as specific health clubs, schools, large public spaces, government buildings, bathing beaches, and dental offices.

Physician

A licensed physician must be involved to ensure AED programs follow all rules and regulations.

CPR/AED Training

(a) Public building managers should recruit or assign employees, in line with labor laws and agreements, to operate AEDs. Ideally, there should be at least two trained operators per AED or two per floor in multi-story buildings. These operators must work near AEDs to meet the required response time.

(b) Operators must complete CPR and AED training and renew their certification regularly to stay qualified.

EMS Notification

Organizations with AEDs must inform the regional EMS council about the device’s type, location, and availability.

Maintenance Program

Organizations must maintain and test AEDs according to manufacturer guidelines and government standards. Every AED use must be reported to an emergency healthcare provider. Additional requirements apply for AED programs in New York City.

Notification of Use

Whenever an AED is used on a patient, it must be immediately reported to local EMS, the emergency communications center, or the vehicle dispatch center, as well as the emergency healthcare provider.
